    You don't have to choose between these two options - you can go onto a rolling periodic tenancy - but why not give your LL a heads up to your plans?

    I would write back to the agent along the lines of 'Thank you for your letter dated xyz. Any Notice to Quit we serve will be in accordance with xxx (condition in TA). In accordance with xxx (condition in TA you mentioned earlier) the tenancy will continue as a contractual periodic tenancy beyond the Fixed Term/Initial Period. Regards xxx'

    Contractual periodic tenancy

    I have an assured shorthold tenancy agreement for 6mths that ends on the 31st of December.
    The contract states the tenancy will continue on as a contractual periodic tenancy after this time.

    I received a letter from the landlord/estate agents saying: "Could you please confirm your intentions
    as to whether you intend to renew your tenancy agreement or whether you are intending to vacate the
    property at the end of this term"

    We will be likely moving in the next couple of months and don't wish to take another 6 months agreement,
    I'm I correct in thinking I don't have to inform the landlord of our intentions and choose between
    the 2 options they are asking?

    Thanks for the replies so far so this will be for an electrical safety check EIRC, and also the electrician has suggested the consumer unit is updated. As it so happens he has managed to get this in for a weekend so problem solved now. However my tenant has stated they will be working from home permanently...

    It is not in the gov interest to lift the stay even in June and the reason not to do it can always be found. If it happens in a June we will be very lucky. My tenant knows this and that is why he ignores the court order....

    Don't underestimate that.
    Flats can be hard to set up as HMOs because of fire escape routes as well as all the usual stuff.

    I'd say that must be unusual, the government rent a room scheme is specifically designed to encourage people to have a lodger.

    A head landlord creates a tenancy to one person for a flat.

    That one person lives at this flat as their main residency, but lets a room to a lodger, this 'immediate' 'resident' landlord shares the kitchen and bathroom with this Lodger.

    1 - Strictly speaking yes, but I'd follow the advice of DPT57 in post #2
    2 - If the tenancy was periodic, yes as far as paying the council and the utility companies are concerned. You may have a contractual right to recover the costs from your tenant if the tenancy agreement says so.
