    Are they sitting tenants

    I have rented a property to a lady for 17 years but now I would like it back. She is not prepared to move...is she a sitting tenant?

    In brief; she is most likely to be an assured tenant, in which case she would have to be in arrears for you to be able to evict her , starting with a section 8 notice.

    Although it is possible she could be an assured shorthold tenant as long as the relevant notice was served before the tenancy started. In that case, all you need to serve is S21 notice before you can start possession proceedings.

      Agree with Bel - most probably an Assured tenant -have you increased the rent in line with market value?
