    Moving some furniture in early, maybe a rent free period?

    My perspective tenant came round today for a second viewing and to measure up. He asked if it would be possible to move stuff in early. I pointed out that he had stated the move in date was 25th Aug and leaving stuff would be at his own risk. We have yet to sign the tenancy agreement.

    From my research some landlords say yes and some say definitely no because the tenant could argue the tenancy started without a contract. I wonder if there is a middle ground with a rent free period whereby the tenancy agreement starts on 22nd with me proving the keys, they takeover the utilities and council tax, but the rent only starts on 25th Aug.

    I think you should be able to have a tenancy for X months and 3 days from and including 22 august to and including 24 of some future month, rent of £Y payable monthly in advance with first payment due on signing the contract of £Y to cover the period 22 August to 24 September and subsequent payments of due on 25th of each month (from 25 September).

    I have done similar when I have been unavailable on the "required" start date and so have allowed a few "free" days at the start.

      He could argue he has taken possession early. Avoid. Either change dates or say no.
      I am legally unqualified: If you need to rely on advice check it with a suitable authority - eg a solicitor specialising in landlord/tenant law...

        Just offer to start the tenancy early if he needs to move his stuff earlier. It wouldn't be enough to say AYOR if he later claimed something valuable was stolen. Likewise if his stuff included batteries that exploded and burned the property down, you insurance probably wouldnt cover you.
