    Best method of getting rid of tenant without courts

    Hi there,
    i know this is frowned upon by many, but facing the costs of a lawful eviction is impossible.
    is there anyone out there that has a good method of getting rid of their tenants without resorting to the courts...
    ie; total re-furb..take toilets out...turn water off etc...
    move in to property yourself...etc...
    please help!!

    1. Offer them money
    2. Offer them a much more attractive property.

      Pay them a large sum of money to move out.
      Put the rent up over a period of years.

      It's not a question of other methods being "frowned on", more that they're mostly criminal offences.

          I agree with offering money. I have done it many times. I deal mainly in HMO's. The court fees are over £350 so I offer up to £350 which will give them a months rent for someone else. I know this sounds a terrible thing to do but business wise with the lag time of court being 5 or 6 weeks and then 2 weeks to move out and then maybe bailiffs it makes financial sense. I Just get them to sign a short note that they have given up the tenancy (no mention of money) the keys and the money are handed over. I keep their stuff for a couple of weeks if they want but they have to arrange to take it from outside.

            my tenant owes 2 months arrears and is starting to dictate what he pays, and when.
            i am sick of it.
            I am considering taking him to the small claims court...hopefully it may make him think twice before ripping me off again...

              By the sounds of it i doubt he will give not paying rent a second thought, there are tenants out there who's MO is exactly this, i would go down the payoff route, it may stick in your throat but financially it makes long term sense.

                That's an excellent idea.
                That route is available online and will make the tenant aware that you are serious.

                If they owe two month's rent, you can also serve a s8 notice with the mandatory ground 8 as well.

                But it's a business, you have to not take it personally and deal with it patiently.

                  ..great, but tenant doesn't have to permit the refurb work: Essential repairs perhaps, but their tenancy continues, even if they HAVE TO temporarily move out - AT YOUR EXPENSE - then move back in, so no change there...
                  take toilets out...turn water off etc...
                  Both criminal offence harassment and/or illegal eviction so you hopefully in court, possible criminal record, fines can be in £10ks...
                  move in to property yourself...etc...

                  Why do you think your tenants would permit this - they don't, unless it's a HMO with spare space. Even if that they remain AST tenants and you still need to go through normal s21/s8 eviction process, involving courts.

                  Other than bribery, or simply asking tenant nicely to go, it's courts: Good old British justice making sure law-breakers pay for doing so:

If the costs of a lawful eviction is impossible then sorry but you've got the wrong £££ business model if you can't cope with or haven't planned for using the bleedin' obvious legal remedies. All businesses from time to time have unwelcome expenses, hardly surely a shock?

                  What training have you done in landlord/tenant law please? When I started I thought I knew what I was doing, ignorant and stupid mistakes, expensive, painful, long-drawn out!

                  I am legally unqualified: If you need to rely on advice check it with a suitable authority - eg a solicitor specialising in landlord/tenant law...
