    Seeking eviction

    Hi everyone,I was wondering if someone could help, I have a family member who is renting out his property ,the tenant has been there roughly 14 years she lives there with her 2 older children who also work ,the issue is for the last few months she hasn't been paying the rent and also been slating him on social media which he has found out about, the other problem is that there is no actual tenancy agreement in place as far as I no just a contract saying he is the landlord and how much the rent is each month, where does he stand in processing with any sort of possession of the property?

    We need to establish if this is a 'regulated tenancy'.

    'Roughly 14 years' is a bit vague - when exactly did she move in and under what circumstances?

    Did your family member buy the property with the tenant in situ?

    We would know exactly what the contract says.

    What sort of thing is tenant alleging on social media?

      If there's a document that says who the landlord is and what the rent is, that's a start.
      When did the tenant move in?

      And what are they saying on social media and is it true?
      When I post, I am expressing an opinion - feel free to disagree, I have been wrong before.

        Thanks for the reply, I'll find out the full ins and outs, he had already bought the house before deciding to rent it as he'd moved out of the country , I will get him to send me over all relevant information if he can find it all, he knows he can't do anything in the current situation anyways.

            If he bought with tenant already living there, until he serves valid notice(s) complaint with s48 & s3 he's not fully the landlord.

            s48 no rent due, s3 possible fines & criminal conviction.

            Not to mention problem of tenant having to witthhold part of rent for taxx man

            I am legally unqualified: If you need to rely on advice check it with a suitable authority - eg a solicitor specialising in landlord/tenant law...

                      Oh and the new date is from 2015 as she wanted to get a dog so he made the new agreement up with her
