    Address disclosure

    My tenant has vacated leaving a few issues. Guarantor is father but family have fallen out .Can I let father /guarantor know tenant's new address. Unsure thank you?

    Are the issues related to the let and terms of the tenancy agreement?

      I wouldn't.

      Cite the Data Protection Act 2018 (GDPR) as the reason why you cannot disclose data that you hold to a 3rd party.

      You may be able to disclose things about/affecting the tenancy to a guarantor, but their new address is nothing to do with the tenancy.

        Although the address for service of all parties will be shared by the court.

            Its now impossible for you to deny knowledge of his presence and as its a breach of your tenancy agreement you could reasonably be expected to at least investigate it. The risk is probably fairly small, a taking jpkeates point, it may be sufficient for you to write to the tenant and point out the requirements...

            I meant he is a good man in that he only increased the rent minimally over a 5 year period. However, the house was such a dive that I guess he couldn't have done so without updating the interior....

            The only thing is the cited items are not junk. They are working items which to any sane objective mind gives the landlord the opportunity not to have to purchase these items at a higher cost. Setting aside the arrears, which is a separate issue, my proposal suits both parties, less financial headaches...

            The ones I've watched round here have been withdrawn for sale once let. Houses with a tenant in place are usually harder to sell and worth less so anyone really wanting to sell is likely to keep it empty. Worth checking with the agent though if it will be withdrawn from sale if you rent it.
