    Communication with tenant

    I have an issue with a tennant, she will not answer the phone or answer the door. She likes to call the shots and has now insisted that all communication is done via text message.
    Her written English is extremely poor, many messages are difficult to understand. She is complaining of mould and damp hasn’t given specifics and insists that I organise to view via text, I presume this is so someone else rather than her is at the property when I go.
    i have requested that she rings me to fully discuss the issue and her behaviour such as drying washing indoors, not opening windows etc and she refuses.
    i have said to call me to arrange a suitable time to go to the property, but she said no text me etc. This has turned into a standoff.
    She is also almost 3 months late with rent, having had a universal credit direct payment redirected back to herself by changing her circumstances by telling them the boyfriend had moved out. That has been done 3 times since the start of December.
    Do I have to do as she says letting her call all the shots ?
    She spends her time sending me threats of various authorities etc but whenever I have passed the property the curtains are closed and windows firmly shut.
    i have had a damp guy to the house in the past before she lived in the property, he said nothing was wrong other than lifestyle and this tenant seems to be living in the same manner, doing clothes indoors on radiators, not opening windows etc.

    What does tenancy agreement say about how notices are served?

    I would write (yes WRITE , keep copy) a calm and polite letter enquiring about any repair issues to be answered on letter and also giving notice of inspection. I no refusal of inspection turn up, calm & polite, with witness, knock and if no answer key yourselves in. If asked to leave do so.

    What does tenancy say about requirements of tenants to report repair matters?

    Also serve s21 and S8 for any grounds that least 8, 10&11.

    Think you need to more forceful, whilst calm & polite. 3 months in arrears and not started eviction process!!

      Sounds like she knows what shes doing. Write to you about the mould problem. Make it difficult for you to inspect without refusing access. If you serve a s21 notice she can show her complaint to the Council and ask them to serve an improvement notice, which would invalidate your notice. If you serve a S8g8 notice she can easily delay a possession order by claiming disrepair. I sometimes wonder whether tenants who intend to stop paying the rent do all they can to encourage mould for this very reason.

        I cannot issue a s21 as I stupidly gave her 12 months which ends in 1st July.

          I will however issue a s8 notice, should I perhaps offer her money to leave ?

            Your choice but I'd not offer a crook money: Only encourages the b*st*ards

                You could have had 3 s8s already served and have applied to the court already.

                Yes s8g10 may be validly served if only 1p is underpaid for only 1 day. Sometimes tenants take the hint - just costs a stamp

                  I will operate exactly the same as I did before the crisis. This isnt something which comes along once a year or even every 10 years. It's also had an effect on every area of society not just the self employed or the low paid workers etc. This extremely rare type of event shouldn't affect your selection...

                  I've been reading all the chat on this forum and was thinking about what it's going to be like after, will landlords be more weary of self employed tenants, have more uc or pack in all together ? Interesting times and the tenants are going to struggle even more as landlords try to doubley make sure...

                  The government did not have to take the steps they did to combat the virus.

                  I guess quite a few landlords here may be in the same situation that tenants stop paying anything due to corona virus.

                  I understand it is a difficult time for everyone. Knowing the fact that Government can pay up to 80% of the salary for anyone affected, it would be OK for me for example...

                  Exercising a break clause is not serving notice (unless the break clause is badly written).
                  If the tenant does it, the tenancy should end at the break.

                  Because the tenancy has ended because of "a surrender or other action on the part of the tenant" an SPT shouldn't arise...

                  Just because they are a big company does not mean they have a full and accurate understanding/interpretation of the law.

                  a) Assuming that the agreement is for a fixed term, and does not contain words about "continuing monthly after the initial term, then it is absolute rubbish, is not legally enforceable, and shows that the authors do not know what they are doing.

                  I think there'll be a dip in property prices post event.
                  There'll be a lot of dead, grieving and damaged people and lots of businesses and jobs will be gone forever.
