    Witness to notice being served

    Hi - can anyone help with a query?

    I (the Landlord) am serving a notice to a tenant’s address in person and am arranging an “Independent Witness”.

    Does my husband or mother qualify as being “independent”? Neither of them are joint landlords, nor joint owners of the property .

    Any advice much appreciated.

      No, neither is independent.
      They can witness the service though, because it will only matter if the tenant claims not to have received the notice and if your witness videos you pushing it through the tenant's door, that should pursuade any judge.

      Personally posting from a post office with proof of postage is preferable.
      It's almost unheard of for post not to be delivered.
      When I post, I am expressing an opinion - feel free to disagree, I have been wrong before.
      Please don't act on my suggestions without checking with a grown-up (ideally some kind of expert).

            We were in this situation very recently and looked to pay for the service from the agents who found the tenant in the first place. Interestingly they just send one person and video the handing over but did say that posting through front door would have sufficed as evidence.
            So we decided to serve ourselves and took footage. The T refused to sign to say that they had received it, but this made no difference to it being served. Hope that helps.
