I am afraid you may have given him a way out of paying you the missing rent by going down the '' carpet'' route, how did you communicate your idea of swapping outstanding rent for carpets ? If it was written then he has you over a barrel, he could argue that he did replace the carpets and may have any court siding with him (they won't listen to the receipt route)....... never ever mix rent with any other '' service'' or ''goods'', they pay rent or bugger off and nothing else pollutes this, it confuses the matter and can be beneficial to dodgy and manipulative tenants.

Thanks Hudson01. We discussed it first and then I confirmed the agreement in an email stating that I wanted quotes and samples first before he'd get permission to purchase. I actually waited two years and he eventually put in an email that he had a problem with his contractor and wasn't going ahead with carpets. When I chased the outstanding rent again he gave his notice and said he'd installed carpets. That wasn't the agreement.

Why spend money on the carpet, if he was going to leave the property?

My tenant missed two months rent payments. We agreed that the tenant could put some of the rent towards replacing a worn carpet subject to him providing a quote and sample of the carpet first. I also informed him that I would require the receipt for the supply and fitting of the carpet.

The tenant never did get quotes or samples and the rent remained outstanding. I sent several emails and chasing the rent with no reply. The tenant has now given one months notice to terminate the agreement and claims that all of the outstanding rent was spent on replacing carpets. I have not had any quotes, samples or receipts supplied to me. The tenant is ignoring my requests to visit the property and will not communicate any further with me. He vacates on 1st December.

Can I make a formal demand for the outstanding rent to be paid as I was not supplied with any quotes or samples? I do not know what the carpet looks like or even if one has been put down.
