    Eviction process

    Could I please ask for guidance from the forum. If there is a residential AST which started May 2015 (ie before the 1 Oct changes) , which was fixed for one year but which then rolled into a periodic tenancy, what form should be completed to proceed with an eviction. I believe it is the Section 21 1b. Whilst the tenant has regularly been late with monthly rent, and is currently part-paying, I am not proposing an eviction based on the tenants breach of the AST. Thank you

    There is some debate in legal circles as to whether or not all S21 notices must now be on the prescribed form.
    I would use the prescribed form.

    Note that if you decide not to use the prescribed form, then just issue notice under S21; do not restrict it to a paragraph within S21.

      Use Form 6a, it's what the court will expect.

      But also issue (but not act on) s8 for all arrears. And explain to tenant "intentionally homeless"
      I am legally unqualified: If you need to rely on advice check it with a suitable authority - eg a solicitor specialising in landlord/tenant law...
