    Tenant Question - Just moved into a property with a broken shower and bath.

    Hi there landlords. I wondered if someone could please help me as to the legal nature of a problem im having.

    I have just moved into a flat (private tenant) and have found the knob that turn on the water to the shower and bath is broken. so i have no running water to the shower or bath. I do have a working toilet and bathroom sink, i also have a working sink in the kitchen to wash plates etc. I have complained to the agent and they are being very slow. I have also questioned (in a polite way) the legality of renting a property with no shower or bath. they have sent me a bit of a snotty reply saying that as i have a working sink in the bathroom this constitutes the ability to wash and is completely legal.

    TO me that seems like it cant be true. But maybe it is? So far i have been polite and reasonable. I haven't said anything stupid or threatening and the relationship is fine with the agent. They are just very slow and are dragging their heels with fixing the issues, it's be a week so far and no sign of any repair for the water knob.

    Any advice greatly appreciated. It is also worth noting that they knew the shower was broken before i signed a contract and moved in, so I'm feeling rather duped.

    A week isn't that unreasonable - but I'd expect you to have a date for someone to come and fix it by now.

    Advertising a property with a bath and shower without telling you they needed to be repaired is a misleading omission and that's not legal (they're right about the sink meaning the property is inhabitable).

    And you're right to feel duped, because that's what they've done.
    A formal complaint and trading standards are possibly your next moves, but they would be a significant escalation.

      Ok thank you jpkeates i think i'll be patient for a while. I really don't want to get into a back and forth with the agent going to trading standards. I might if this doesn't get resolved quickly though.

      Thanks for putting a week into context, it feels like an eternity for me and i know the repair is likely to take ANOTHER week or 2 or 3. So it's incredibly frustrating. But i do take your point that 1 week isn't a crazy amount of time.

      I'll sit tight for now and keep politely chivying the agent.

        I think that's wise. It doesnt pay to question the legality of what they're doing unless you're in the endgame. It's likely that it's down to inadequate inspection rather than deliberate deceipt so I would just keep up the gentle pressure asking for daily updates.

          The thing I think that is the agent not doing their job is that at least they should have arranged someone to come and have a look, even if that's in a few more days time.

          I can't ever get a plumber right away, but I can usually get someone to agree to come in a few days.

          My next question for the agent would be what's causing the delay because it's plumbing, the landlord has an obligation to repair it (it's not up for debate)?

            LL has duty to inspection/repair, but in the same timescale available to other householders (Denning).

              I agree, but most home owners would be able to arrange a plumber's appointment in a week, even if the appointment was some day's later.

                  Single glazing glass tends to be of standard thickness and not toughened..
                  If you do not like the Property/LL, give due Notice and vacate.

                  I might wait to see what effect the Budget and Brexit may have on the economy.
                  Keep any rent increase to max 5% p.a.

                  work out inflation over the period, and if your increase is less than tha, then put it in the letter for comparison.

                  My view is that you do tenants no favours by charging below market rent as they just develop unrealistic expectations and feel trapped when they realise they cant afford to move but need to. They also see you as a soft touch and that's not a good look for a landlord. I would start to increase each year...

                  At what height was the bottom of this window, "normal" window height or floor height?

                  If floor height, then I believe it is required to have toughened glass, which is harder to break.

                  I don't think you are even allowed to advertise it for rent without a valid certificate. However, unlike the gas one, you can still provide it late for a section 21 eviction.

                  It was a C. Yes im going to try and get it done asap before the new tenant moves in.
                  Also the gas cert was done in jan, so is valid till jan 2020, but will that be needed for a new tenant right away as well?
