    Contractual mistake mess

    Hi,

    I rented a flat with another guy and in the AST someone had put in bills included, as in, checked the boxes where bills are included, altho they were not (it was my second year in the place so all the bills were already under my name, and i was paying them). now, the tenancy is over and my flatmate is refusing to pay his part of the bills saying that bills are included according to the contract, altho he did pay some of it in the past. What can be doe to make him pay, its more than £600 and the landlord's reply was "i'll give you £100 out of his deposit but that's all i'm willing to do"
    on top of that the ex-flatmate now lives in another country outside the EU

    You've probably got little chance of suing the ex-flatmate, especially if he has moved outside the EU. You could try suing the landlord for the cost of all the utilities but you probably need legal advice first on the strength of your case.

      isn't the fact he payed some of the bills and they were on my name meaning he agrees the bills not included in the rent?
      i'm originally from the same place as the ex-flatmate so i could potentially sue him.
      i would hate to sue the landlord as he's a really nice guy and was always helpful.

        It sounds like a mistake in the contract (presumably everyone knew that the bills weren't meant to be really included in the rent).

        If you're from the same part of the world as the ex-flatmate, can you claim the money there?

          yes its a mistake, but how do i prove that in small claims court? should i just show our correspondence about the bills in the time he was still paying and receipts from his payments directly to the power company himself?
