    Change of named tenant

    We have been renting out our 3 bedroom house to the same tenants for 2 years. Up to this point the household consisted of a male, his girlfriend and the girlfriends brother and they have been good tenants. This week we learned that the girlfriend has moved out and the man wants to add his new girlfriend onto the tenancy. The main concern is that she is bring 3 children with her. As the original girlfriends brother plans to remain at the property (which seems a little strange anyway) the occupancy of the house would be increasing from 3 adults to 3 adults and 3 children in a 3 bedroom house.
    Our concerns are for increased wear and tear and a possible change to our insurance premium. On the other hand if we decline there is a very high chance that they would move out or cause problems (of which we have already had plenty with a previous tenant).
    Any thoughts? We have discussed with the agents but not had definitive advice.

    You now have two households and six people. You have an HMO subject to mandatory licensing.

    The HMO, although not criminally overcrowded, assuming a reception room, is over the bedroom standard, so HMO licences may not be available.

      Also, the only safe way of changing a named tenant is to surrender the existing tenancy and start a new one.

        Thanks leaseholder64. I hadnt actually looked at the HMO side of it but you are right - the brother of the ex-girlfriend is now a separate household. Will get back to my agent. Thanks again.
