    Possession Order after s8

    Hi All

Our tenants were given notice and we went to court to regain possession. This has been granted by the County Court and she was supposed to leave ysterday. While I believe the tenants have moved out, I also believe there are still a few odd belongings there. At what point can I (or my representative) legally enter the property and change the locks? (understanding that I have to make reasonable attempts to return the tenants belongings)

When you get the council tax bill?

The safe position is to get a signed surrender from the tenant or wait for bailiffs to execute the order. Something in writing (eg an email) stating she has left would be next best. Otherwise you could get sued for illegal eviction

Explain rent still due whilst her stuff still there unless she'd like to agree terms of surrender .by email
I am legally unqualified: If you need to rely on advice check it with a suitable authority - eg a solicitor specialising in landlord/tenant law...

I believe that rent is due until possession is returned to the LL.
