    Tenant Eviction

    Hello
How do i evict a tenant without a tenancy?
I took over management of a property from another agent and the tenant always refused to sign an AST.
He was paying the rent for 7 months, but has now stopped paying.
I'd like to evict him. I usually do s21 evictions.
But for these i use an AST and S21 with the claim form.
How can i evict in this case?
    Thank you.

Without a tenancy agreement, not without a tenancy. If the guy's paying rent and not lodging etc., then almost certainly have a tenancy.

First, establish what rights he have. Post-1996 start, rent-paying not too high or too low, doesn't live with landlord etc., then AST.

Serve s21 (or s8) notice as usual. No tenancy agreement mean no accelerated possession, so non-accelerated possession claim with hearing in person.

If you are agent you cannot enforce eviction through court. Only a lawyer can represent landlord in court, you may not do so.
I am legally unqualified: If you need to rely on advice check it with a suitable authority - eg a solicitor specialising in landlord/tenant law...
