    Furnished flat turns out to be unfurnished

    Hi I'd appreciate some advice here.

    I've rented a flat from a friend of a friend, no agent involved. Went to view it and was told that, asides from a couple of bits n bobs like a mirror or picture on the wall what I see is what I get.
    I was happy with what I saw, sans bits n bobs, and agreed to move in today.

    Move in day was today and indeed the flat is without the bits and bobs, and practically without anythingelse at all. Besides a mangy fridge freezer that wasn't there when I saw the property, the oven and sofa, everything is missing. Even light bulbs, bathroom cabinet, bed... The lot. I signed the tenancy agreement at my house, but noticed that nothing was listed under inventory. It doesn't say "no furnishing" it's just a blank space. To be honest I didn't really care as my friend recommended me so I thought everything would be OK. But I'm not OK. I can't afford to buy the furnishings, but I don't want to risk losing my landlords favour, or my mate who recommended me. I've asked the landlord about it and so far he's said that he can't get hold of the the nant.

    What do I do now? Really need good advice here. I think I may have been stupid

    Is this a sublet situation? What does the tenancy agreement say about furniture? Have u paid up front?


      There is no clear definition of of part or unfurmished.
      What extras were you expecting for furnished?
      Sight as seen acceptance may be crucial


        Since it is 'a friend' you are renting from then surely you can ask where the furniture is or say you made a mistake and want out of the agreement.

          Sounds like the previous tenant stole it all.

          If you were told "what you see is what you get", then that forms part of the contract, even if not written.
          LL is obliged to give you what was contracted.

            I am very sorry to hear that.

            You may be able to call the police for malicous damage.

            Property insurance for landlords, normally do not cover malicous damage by default, only accidental, however it is usually available as part of additional premium. Check your coverage small...

            I am not experienced enough to offer the advice i know you need, but is suspect (as you have seen) that the police will be of no use in this instance, they will still see it as a civil dispute right up and until the whole interior is destroyed. I am so sorry this is happening to you and i trust a member...

            Wondered if anyone has thoughts on use of s21 (while we still can!) when a tenant has been great at paying rent but is just very demanding - significantly more work than the other four properties combined. The main issue is mould on the walls - it’s an old building recently refitted to modern insulation...

            Tell the tenant the property is not suitable for their lifestyle and invite them to leave, s21 if they dont.

            Thanks all. I suspect leaving the whisper quiet extractor fan on will fix the problem. Hard to tell because he hasn't left it on. And if he turns that off he'll turn off a PIV system too.

            MdeB - yes Jpkeates is right. Warmer air can hold more moisture so there's more water to condense...

            The moisture that's in the air has to go somewhere, if the updated insulation has closed off where it used to escape, it'll hang around until it finds a cooler surface to condense on.

            If a damp expert declined to do anything about it, that suggests that whatever they could do, they knew...

            They are trying to claim I caused damage to the carpets and walls but this damage actually belongs to the second flat in the same building and was caused by the previous tenant of that flat who left...

            While it's common to give the Prescribed Information to the tenant with the Tenancy Agreement it can backfire if the deposit isn't actually protected at that point, because the Prescribed Information is technically not correct.

            It will be almost impossible to take legal action from outside...

            The prescribed information was signed by myself and the letting agent at the same time the tenancy agreement was signed and the keys were handed over. I wasn’t actually given a chance to read the prescribed information before I signed it. The prescribed information...
