    Agreed move in date later than tenancy agreement - when does contract term end?

    Help please. I agreed with my tenant (in writing) for her move in date to be later than what was documented in the tenancy agreement. The tenant now wants to move out at the end date stated in the tenancy agreement rather than the 3 month contract date after they moved in? Can I hold them to a 3 month contract? The deposit was registered with DPS on the date they moved in with a three month term. Thanks

    If tenant has a signed contract with a stated end date of course they can leave on that day: They don't need to give any notice.

    Was deposit protected more than 30 days after it was paid? If so tenant is entitled to sue you for up to 3xdeposit.
    I am legally unqualified: If you need to rely on advice check it with a suitable authority - eg a solicitor specialising in landlord/tenant law...


      The move in date doesn't have to coincide with the tenancy agreement start date.
      The tenancy doesn't begin until they move in, but the contract does.

      I don't think you have much choice (as long as they're not asking for any rent back) and don't leave yourself in the position that you have separate agreements that vary the main contract outside the main contract. Next time, re-issue the tenancy agreement with the amended dates.

          My gut feeling on this one without any further investigation would be a big fat NO, there is too much of a 'story' to tell and that alone would ring many alarm bells for me, he maybe an ok chap but i would not take that chance where there are lots of other tenants to pick from out there.

          The LL appears to not have a clue what he is doing, but that aside the end result (way down the line) will be your leaving this property, you know this will occur so make real efforts now to look for something else, leaving under your own steam is far less stressful than with someone else's assistance....

          They were given the keys by the tenant's brother who stayed on for a while after the tenants moved. No rent paid for over 10 months.

          Edited to add tenants moved out last June....

          I have just been told by my insurance agent that current insurance company have refused to insure again due to the illegal occupiers currently living there. He said of all the others he contacted only one would give a quote - this was hugely inflated and had exclusions which I am not happy about....

          No it wasn't me, this is my only post on the subject and I only found out today. It's not a rent to rent scheme or HMO just two men living there who aren't the tenants.

          Well it might have to be persistent to really be harassment, but basically its trying to take away the tenants right to due process. It's normally recommend to make tentative enquiries verbally or through a solicitor....
