    As a landlord Moving into as lodger of the tenant before tenant moves out

    I would like to check on one scenario.

    We've rented our living flat on residential mortgage on AST, through agent. Now as situation has changed, I need to move back. and also has served notice to end tenancy to the tenants.

    Now, because of urgency thinking to negotiating with current tenant to take-us as Guest / lodger (will pay them).

    Also at the end of their tenancy, would give them option to stay for some more time as our lodger (if they want to).

    If tenant agrees to is it okay to do this arrangement?

    [Although its not very ideal solution but just wanted to check]

    Even if your notice was valid it does not end tenancy nor require tenant to leave. Only a court can force that:. Months later.

    Suggest other plans.
    I am legally unqualified: If you need to rely on advice check it with a suitable authority - eg a solicitor specialising in landlord/tenant law...


      I think you would start to open a can of worms using this approach, you are better off living with relatives/friends or a short term (6months) accomodation. Then trying to resorting to being the tenants guest, and then vice versa.

      Issues living with a tenant can come about very quickly and then the nightmare begins in trying to serve section 21. You would also be causing the tenant in creating a breach in contract by subletting to you (even if you own the property). Your best action is to remove the tenant, and then move into the property once the tenant has vacated the property.


        Thanks for your response. We already have served the section 21 notice. Kindly suggest in this case.


          If the s21 is valid (many are not), complete the Eviction process before moving back.
