    Late payment fees

    There is a clause in the tenancy agreement that’s states ‘there will be a charge of £60 per infraction’

    I presume this means a £60 charge for each month the rent is late or missed??

    is this enforceable? Would the court deem it as reasonable? I am putting together a rent arrears schedule for a s8 and wondered whether to include it?

    As it's your contract, surely you know what it means and the implication? If you don't know then how is the tenant supposed to?

      Are you going for S8 including money order or S8 & later separate small claims for money?

      If S8 and money forget the penalty, you'd be handing an opportunity for tenant to challenge.

      I suggest you priority is possession.
      I am legally unqualified: If you need to rely on advice check it with a suitable authority - eg a solicitor specialising in landlord/tenant law...
