    Deposit Dispute

    My tenants have recently vacated my property after 5 years living there. The property and garden was left in not a great shape and one of my main issues is with black mould in the upstairs bedrooms and bathroom even though this was last treated and painted 6 months ago. The tenants took with them several of my items that I kept in the house and left rubbish in the garden shed along with a swing in the garden which I do not want.

    I asked for 50% of their deposit to cover the cost of rework for damaged items and the return of my belongings. The tenants made me an offer of £300 to cover the missing items. They say are not at fault for the black mould even though I had the upstairs ceiling treated and painted a couple of times the last one being 6 months ago and an independent damp survey carried out which stated the cause was due condensation issues. Trickle vents have been fitted to windows and the loft reinsulated all within the last 12 months

    My letting agency say they will do all the paperwork to take the matter into dispute but did say the panel generally come down in favour of the tenant. I also know the inventory is not accurate as some of the missing items are not in there.

    Should I accept their offer or take a chance and take it to dispute.

      Very sadly, I'd take the offer. I have never seen an adjudication award more than buttons.
