    Tenant damaged the property and took items - what do I charge him?

    Hi all,

    What amount do you put for damages at the inventory check out? Is there a list somewhere that I can refer to please?

    The main unknown is the expected life of the item in a rental property.

    You basically charge the purchase price, written off over the expected life, assuming the damage is sufficient that the whole item would need to be replaced.

      The landlord is entitled to compensation for any loss in value of their asset(s) beyond fair wear and tear that occurred during the lease.

      The formula that they should use, and a court (and the protecting company ADR process) will use is:

      (Cost of the original item and any installation/fitting (not the cost of a replacement) / expected lifetime) * (expected lifetime - actual lifetime).

      That is, compensation for the lost value (life of use) of the item.

      That presumes that the item is entirely ruined and the landlord can show that it happened during the lease.

      Alternatively, an actual repair cost might be claimed, but again, this should be adjusted to reflect the tenant's share of the lifetime (but sometimes this is just meaningless).

        I am legally unqualified: If you need to rely on advice check it with a suitable authority - eg a solicitor specialising in landlord/tenant law...

          When the tenant we took meter readings but subsequently forgot to register with a utility company. The only thing that may have accrued is a small amount of gas .
          Obviously I want to pay my dues.I believe the companies do pass on info between each other Thanks

          Problem is once there is a neighbourhood dispute - if may affect you (and neighbours)if anyone in the future should wish to sell .... there is a question on the T6 asking if there have been any disputes . so be aware of this -

          If the property is fire damage, you may consider converting to HMO, if you are giving it UC tenants there is always demand for large properties, just don't spec the property to a high standard is my advice. Check what the LHA rates as they are normally 80 - 120 more than a 3 bedroom.

          we are buying a fire damaged 3 bed house in a good area which lends it itself to doing a loft conversion due to the fire damage

          how do others find demand for a 4 bed house, we do let to u/c claimants with guarantors and a family...

With hindsight £200 is an excessive deduction for this but I wanted to move on and just agreed. No other damage...

          Jul - I wish you all the best with this, i do not know how long they were married but your father in law clearly knew there could be problems in the future with his soon to be marriage and what could happen if he passed away first...... he was correct.
