  • Memorandum of AST Renewal

    Could anybody please help with a Memorandum of AST Renewal Draft/ Template.

    Neither RLA or NLA appear to do them: Think that's an interesting lesson.

    IMHO either (recommended) roll on periodic, more incentive for tenant to comply with tenancy terms, or issue new AST, inventory, deposit, photos etc etc...
    I am legally unqualified: If you need to rely on advice check it with a suitable authority - eg a solicitor specialising in landlord/tenant law...

      IMHO, what the RLA and NLA do or don't do isn't very telling of anything apart perhaps that such documents do not sell well enough.

        Good point! Went to a meeting of one of them the other day: Left after the 1st, dire, presentation by someone who was either lying or very stupid...

          I am still to find someone who can explain exactly what they are what they do. As far as I can make out agents use them instead of issuing a new revised tenancy agreement and it's a way to ensure their renewal fee. According to the NLA there is no allowance for them within the Housing Act so in essence the terms of the new tenancy remain in place. I have seen ones which increase rent and add additional conditions though. I am not sure how you stand in regards to deposit protection and any other legislation, if would be considered to be a new/renewal of tenancy. I always reprotect the deposit just in case.

            AIUI, such a document can only highlight the terms that will be included in any replacement/new AST offered. It cannot affect your Stat Rights to current Tenancy/SPT. If T does not accept Terms he/she can refuse any new AST& give due Notice on current Tenancy. LA may use it to inform LL of any proposed changes to new AST which LL can reject, but should have been proposed by him anyway.

              Presumably, an AST "renewal" creates a new tenancy, because it can't extend one.
              So why is a different document better than a new tenancy agreement - which at least everyone recognises and understands?
              When I post, I am expressing an opinion - feel free to disagree, I have been wrong before.
              Please don't act on my suggestions without checking with a grown-up (ideally some kind of expert).
