    Hi all,

    I have recently purchased a house through auction. We had taken a builder prior to the auction to have a look at the structure etc. However the garden wasn't accessible at the time of viewing.
    We've now gained access to the garden and looks as though neighbours chimney support...

    Assuming, as appears to be the case, that the chimney was built at the same time as the next door house, looking at the titles of both properties may not be conclusive.     From the styles of the brickwork on the 2 buildings it looks like the building with the chimney was there first and yours was later built up to it, as close as they could get to the chimney.

    Look at the old fancywork at the top of the chimney and compare it to the plainer (later) style...

    I'm building an outbuilding to my house
    It start 3 meter away from my house
    The side wall will be built on the boundary line
    Do i need to serve notice to my neighbour?

    I should add, the legal requirement is to serve Notice. Whether an Award is required depends on the response to the Notice.

    Also, the neighbouring owner(s) would need to formally consent to raising a Party Wall as (I assume) the current boundary treatment would not be deemed [by the Act]...

    There's no such [legal] thing as a Party Wall Agreement.

    If you're refering to whether you have liabilities under the Party Wall Act then that depends on what is proposed and what is there at the moment. Are there circumstances where you'd need to serve Notice under the Act for this work....

    It is impossible for us to answer without knowing the details of the existing foundations and your digging. What do you mean by "on the boundary line"?

    In general stuff with neighbours is best done with discussion and agreement. Great big walls at my boundaries tend to get used...

    The planning is on the boundary line - permission was granted for this
    Because the work is 3m+ away from my neighbour's house, i don't think a party wall agreement is needed
    If anyone can confirm this, it would be great

    Why do you want to build to the boundary line instead of a foot away from the boundary line? How will you maintain the wall when your neighbor decides to operate in a similar fashion and builds a wall an inch from the boundary allowing your...
