    Registered access denied, what to do next?

    I (and others) have a Prescriptive right of way registered within the title register of my neighbours land. After he built gates and fences etc to obstruct the ROW, and much 'a to do' the owner and his mortgage lender through his solicitor, accepted the existence of the right and it was formally registered. The owner still refuses to remove the 'obstructions'. Any 'sensible' advice on what or where to go next in order to make him adhere to the Rights of Way and remove the obstructions. I am considering applying for a court injunction but have concerns to the legal costs and time involved.

    Hello,
    I'm not an expert, but I think you have to apply to the court for a court order to remove the obstruction, enforced by bailiffs. Hopefully someone else will confirm..

      The law allows but discourages self-help in such situations as it may lead to injury to persons, damage to property or a breach of the peace. Accordingly court action is to be preferred but can be expensive.
