    estate agent selling a pup

    We have just been presented with a house for development. We challenged the price and were then told that there is a stop order on it from local authority and if anyone buys it, then extension, loft etc etc have to be taken out. What is shocking it that this new information came after interrogation, that the seller is only gong to drop the price by around 2% because of it AND they are likely now going to put the house in to auction where some poor guy will likely buy it without knowing the detail. Is the estate agent legally obliged to publicise this information?

    Not at all. Caveat emptor - buyer beware is the rule at auction or with an agent. You're not buying a new dishwasher!

    When buying property I never trust an agent and make rigorous checks and carry out searches myself. There is a chance your solicitor would have become of aware of the problem in searches so no need for the agent to advertise it.
