    Freeholder consent

    I have bought a flat, one of 5 converted from a commerical unit, with full planning and building control consents. Unfortunately, I have just found out that the developer, the leaseholder, converted them without the consent of the freeholder. Legal action is now being taken by the freeholder against the developer. I am a leaseholder, of the leaseholder!
    Where do I stand, and should my conveyancer have picked this up?

    Yes, your conveyancer should have picked this up. Ask for your money back! Complain to any trade body they belong to.

    I would guess the freeholder would 'come to some arrangement' with the developer/leaseholder over the matter since residential property is more valuable than commercial (usually).
