    Party Wall

    If I'm not going to build on to the party wall, do i need a party wall agreement?

    I'm planning to build my wall with timber from the inside of the party wall without encroaching

    Most grateful for any replies

    There is no legal document entitled 'Party Wall Agreement'.

    Party Wall Awards are only required if a dispute arises after Notice is served under the Party Wall Act. There is a legal obligation to serve Notice if the proposed works fall under the previously mentioned Act. The Act doesn't just cover physical works to a Party Wall.

    You have not provided enough detail to suggest whether [all or any of] the proposals fall under the Act.
    There is always scope for misinterpretation.

    If my posts can be interpreted in two ways, one that makes you feel angry and one that doesn't, I meant the latter.

      Hi Tipper. It was granted for one dwelling but vendor has since built the cabin and fenced off the plot he is selling saying it has planning. But the planning was granted for the original whole site before he built his cabin that he lives in .

      It probably depends on what the permission was for and how many dwellings, etc.
      Also when pp was achieved as they run out after 3 years in most if not all cases.

      You can check on the local planning online to see the details, drawings, dates, etc.
