Can I erect a Boundary Fence

I would like to erect a new boundary fence at the back of a property I own.

Previously the boundary was an old shed, entirely within my property, and recently demolished. However, the neighbour is upset over some work a contractor did earlier and so is trying to frustrate this by saying I cannot dig out and backfill any ground on his side of the boundary in order to support the fence posts. Is he within his rights to do so?

Temporarily replace the boundary with some old palettes. Paint his side yellow and pink stripes.

Use a fence auger to drill post holes entirely within your property. Then fix the fence to the neighbour's side of the posts.
