    4 yrs for resi...which is applied as a matter of fact, but its up to the applicant to prove 'on the balance of probability' that there has been continuous use. If you are uncertain, get a town planner on board!!

      I was just reading through this thread and have a few questions...

      1- What counts as continuous use? If the property is rented for 4+years but has been occasionally vacant for a week or 2 a year for example (i.e. void periods) then would that still count as continuous use. Is "continuous use" defined or is it just a case by case basis?

      2- Anyone have any further thoughts on the insurance indemnity policy mentioned by buffalo747?
