    Shared ownership - building a car port over spaces

    We live in a shared ownership house with two spaces included in our deeds. The spaces are not attached to the house but next to the garden fence. We have permission to build a car port over our spaces, but that we must transfer ownership once built to the housing association, which we have no issue with. They are saying that we must prepare a deed to deal with the transfer as they will then be liable for insuring the structure. We are unsure of the need for the legal documents to deal with the transfer - any help greatly appreciated as area manager not sure what to do and says we must sort all legal paperwork before they give formal permission.

    Sounds reasonable to me. You don't own the land, the HA does.

      Are there two names on the register of title that show you to be an owner of this property with a defined share?
      On the title plan is the red line already drawn to include the house plot and the parking spaces?

      If the red line identifies the parking spaces next to your external fence than there is nothing to transfer as the ownership of the land extends upwards from the ground to the sky and includes everything erected on the land.

      Only if the ownership of the parking space was registered at Land Registry under your sole name could a transfer be made.

      It makes it difficult to understand what the HA are asking for, since they will own the same share of the car port as they do of the house, which all ought to be part of a single Land Registry title.
