    Enforcement Register Wrong - Gone 4 Years. What Now?

    In 2009 I converted a house to two flats without Planning Permission and in 2011 the LPA issued an Enforcement Notice. Due to a number of factors they agreed (I have the emails to show it) that they would withdraw the Notice with a view to reissuing it later.

    As it has now gone over 4 years I would like to regularise the conversion through Established Use. There used to be some debate about whether this needed a 10-year period instead but there is now plenty of case law which shows 4 years is sufficient. However, it turns out that the LPA did not actually withdraw the Notice as agreed but instead marked it in the Enforcement Register as "Complied With" in 2012. It wasn't!

    Given that the Enforcement Notice was issued and not withdrawn, does that remove my option to claim Established Use (even if I say it is only since 2012 I get the 4 years in)?
