consent to remortgage not given

Hi, I had been accused by property management company (freeholder rep) of breach of lease on alterations made in the flat. I had independent expertise confirming that alterations were of non-structural nature and I was not in breach. I now want to remortgage but they refuse to give consent. Any advice...

I doubt if your lease includes a clause stating that remortgage requires consent from the freeholder ??

Please check the wording in your lease ? Does the leaseholder require freeholder consent for subletting ?

Please post up the relevant clause for comment .

If you are willing to pay for window replacement, go ahead because you cannot be sued for replacing your own window.

You should visit the Leasehold Knowledge Partnership website and conduct a search on the agent and freeholder.

Lodgers live in the leaseholder's home ( or rental tenant ) and do not have any legal rights to remain in the property after 28 days notice to leave is served by leaseholder ( or rental tenant ). Therefore the conditions in the Lease do not apply to the lodger.
