    Joint landlord/Owners responsibilites


    I own the downstairs flat of a purpose built building of two flats.
    The owner for the upstairs flat and I have just bought the freehold of the building and have a declaration of trust written into the completion of the property.

    So, is there some document that we now have to draw up to assign responsibilities for the upkeep of the overall property and ground around it? Is there something that could also incorporate shared maintenance costs, and what they should be. We have a very amicable relationship, but should one of us sell, then the other wants to have something in place to make sure that the new owners also adhere to a joint agreement.

    I have googled all sorts of phrases to see if there is a specific term for it, but no luck!

    Any help or advice would be much appreciated.

    Your current leases should already define responsibilities. The leases do not extinguish when you jointly buy the freehold.

      Whether the complaining owner goes to a tribunal or a court, I think that on any assessment a basement bedsit paying the same as a two bedroom flat is not "fair and reasonable".       Call an EGM. Make sure you give proper notice and that it is legal (download a boilerplate notice off the internet). In that EGM you can vote new directors in, or even vote the old directors out.

      There is already no ground rent collected - so as I understand it the value of the freehold might be quite low anyway.

      If this is all done by negotiation then it is a moot point regardless, and it brings me back to what I was actually asking about, which is how to fairly and equitably split...
