    selling leasehold flat - freeholder taken 6 months+ to not yet reply

    The freeholder to my flat has not replied to my and a potential buyer's solicitor's questions.

    He was first approached with a questionnaire in February.
    Repeated contact to try and get a response.
    Still no written reply.

    The buyer has withdrawn from sale at last minute due to this.

    My solicitor is at a big firm and I think is not that bothered as he just keeps sending emails/phones freeholder when I ask for an update.
    Solicitor says if we get a cash buyer who is not concerned about a response then there wont be a problem (!!?), otherwise 'there’s not too much anyone can do'

    I am awaiting a reply from Lease-advice.

    Just wondering if anyone has any advice or experience of this?

    I could let the flat, but the lease states I need the freeholder's permission - which I doubt he will respond to or will deny permission, despite the fact that the flat he owns in the block of three is let out.

    Any suggestions or previous experience gratefully received

    I suggest you change solicitors - sounds like he couldn't be bothered to put in any work to the sale of your flat. Even cash buyers will want answers from the freeholder.

    Have you contacted the freeholder directly asking the question?

      A freeholder is under no obligation to respond, unfortunately.

      all that you could try is a letter stating that you hold him / her / them responsible for not being able to sell your flat and the costs invoved will be passed on to him, and action taken aganst him ( you probably cant take action, but it just may jar him into replying )

          What an MSE type answer

          The freeholder is entitled to his service charge and can and will sue, the buyers will be annoyed as they will want them paid or the price dropped, and of course they are still not obliged to reply.
          Based on the information posted, I offer my thoughts.Any action you then take is your liability. While commending individual effort, there is no substitute for a thorough review of documents and facts by paid for professional advisers.

            It may benefit older leases by removing "marriage value" from lease extensions but this would not help you _ and freeholders are also aware of imminent changes and may be more willing to negotiate prior.

            If the lease states that you may charge a registration fee of £10, that is the amount you may charge, you are not entitled to increase the charge unless the lease specifically allows an increase. Even then you would be limited to a reasonable amount and £100 would be considered to be unreasonable....
