    Freeholder refuses to repair

    please advice

    I bought a BTL flat which had some damp problems. The freeholder has been an absolute nightmare trying to get the damp sorted out (initial damp-proofing was still under guarantee - so it didnt cost them any thing). My tenant had to move out last september 06, to get the work re-done. Rentokil finally did the work on 6 jan this year, all the freeholder had to do was put skirting boards back on, re-hang one radiator and relay the carpets. I have been fobbed off so many times, every appointment to finish off the work has been broken, i ,ve had every excuse, including the carpenter has the flu. I am now going to get the carpets relayed myself and i will invoice them, as thats the last thing to do. i have had enough. they dont return my phone calls. I did not get any contents insurance, and its obviously costing me money every month the flat lies empty.

    i did speak to a solicitor friend who said i could have a case for damages (ie loss of earnings, etc) was wondering if anyone had any experience of this problem or could point me in the right direction.

      I have just noticed something in the articles, the 2006 act doesn’t apply to us, we come under 1985 act if that makes any difference.
