    Bird Drop: Who is responsible for chimney fix

    3rd floor leasehold flat

    For the second time in 2 years, a pigeon has fallen down the chimney (probably not the same pigeon as last time though)

    The bird bought down quite a bit of debris over the new floor. My builder who had just fitted a kitchen, said it look like old chimney lining

    Dropping birds are a health risk and inconvenience

    Which party is most likely to be responsible to pay for the chimney to be be modified so this cannot happen again?

        I am about to ask the housing association. If they say it's me then I will look at the lease!

          I wouldn't bet , I would look at the lease

              Which is why I knock these RSLs and Councils. That builder has to be paid for either out of service charge ( and I can guarantee he has no specialist understanding of linings, nor access to the chimney top, nor even a scope to take a look up the chimney)
              or their repairs budget which comes out of their income. Or it will be one of their surveyors, who will be similarly limited and very often are not even qualified or experienced.

              The correct procedure, as a PM, is to pull out the lease and look. of course with their "repairs teams" they don't have access to that, and the person who does will no doubt not reply except in " 10 working days".

              Simple - grab the lease read it and reply " us, sending someone, or sorry, it's you".

                Have demands been correctly served including the correct summaries of rights and obligations?

                Are the landlord obligations under the lease being carried out?

                Thanks for your response.

                All costs are being covered by the management company. So currently I'm not actually losing out so I'm not really sure what I'm claiming for! More just the stress of it all. And the potential loss of earning and making unrentable/saleable as you say. Yes the floor...
