    Lease Details

    I often download lease details when viewing auction websites, noticing some leases inform the holder of such things as no letting permitted etc.

    My question is can when you extended the lease insist that these issues be altered, is there some kind of panel where you can have these issues fairly changed or are you stuck with the decision of the free holder?

    You can ask in negotiations with the landlord and if you cannot agree the terms of a statutory renewal the LVT will rule.However your presumption is faulty, particularly on fairness, there has to be a good reason for needing a change not simply that you prefer it or would like it or it would be beneficial or seems odd to you. leases are what they are take them or leave them the basis of altering them is one of rectifying defects, and when it comes to a commercial arrangement such as letting the landlord is free to decline.

        Call an EGM. Make sure you give proper notice and that it is legal (download a boilerplate notice off the internet). In that EGM you can vote new directors in, or even vote the old directors out.

        There is already no ground rent collected - so as I understand it the value of the freehold might be quite low anyway.

        If this is all done by negotiation then it is a moot point regardless, and it brings me back to what I was actually asking about, which is how to fairly and equitably split...

        That potentially raises an interesting question about what happens to any money that needs to be paid for the enfranchisement.
        At the moment payment is handed over, all those in the block being enfranchised would presumably cease to be members of the company - so wouldn't be entitled to any share...
