    Can we still buy the whole Freehold?

    Hi All,

    I hope you can help as I'm in need of advice.

    In November 2011 we (2 flats) were served a notice & first right of refusal for the lease being carved up - it was an offer (extremely high one!) to
    buy the airspace above the roof. We had a deadline of 2months.

    In December we served a section 13 to buy the freehold, the same week the
    freeholder put solar panels up on the roof (before the 2month notice was up)

    We have subsequently found out that the airspace lease was sold to another company, after internet searches the freeholder owns that company as well.

    Does this mean we can still buy the freehold? He has offered us the
    freehold without the airspace which we don't want. We want the whole freehold.

    Any advice would be much appreciated as we are quite confused!

    Buy a copy of the freehold title for your address from Land Registry and check who or what leases are included under the freehold title. It costs 4 pds by credit card.

    Then put your enquiry to LEASE ( www.lease-advice.org ).

      Can you describe what actually happened, this is a mass of contradictions.
      Based on the information posted, I offer my thoughts.Any action you then take is your liability. While commending individual effort, there is no substitute for a thorough review of documents and facts by paid for professional advisers.

        A notice was served by the freeholders to both leaseholders offering the airspace above the property giving us first right to buy this. It gave us a deadline of 7th January 2012 to buy.

        In December 2011 we served a section 13 to buy the freehold and they had until Feb to respond, they denied our notice and offered us the freehold minus the airpspace.

        I should also add in December 2011 they added Solar Panels to the roof.

        Does this help clear things up Leaseholdanswers?

            They served their notice to split the lease in November 2011 and completed the registration in Feb.

            We served our notice in December 2011 before the end of the right of refusal and before they put solar panels on the roof.

              Any meeting which you decide to hold will be an informal meeting only, you do need to follow the correct procedure if you wish to hold a valid meeting,

              The Articles should state whether or not directors need to declare conflicts of interest and whether or not they are entitled to vote on...

              It is both a managing agent and a residence Association. But we want to go back to managing the block ourselves.

              You are clearly using the informal route and can thus negotiate whatever terms you like.
              freeholder will want to retain some ground rent but avoid the doubling clause, maybe suggest small fixed rises every ten years....
