    Right to Manage - Consent for Extension to Property

    Hi

    Can an RTM company give consent to put a mansard roof on a house (it is currently split up into 4 x 1 bed flats)? Or would the freeholder still need to give his consent?

    The principle is that consents are primarly dealt with by the RTM with consultation with the Landlord.

    However in this case it depends on whether the lease includes the loft space, or if the area has any restrictions or rights over it to see if the flat owner can do anything to it.

    Any rights restrictions or change of use ( from storage to residential) or if it is reserved to the landlord, any consent ( and in the latter case a sale) would therefore attract a premium which accrues to the landlord.

    The mansard would project into the landlrod air space which may kill it entirely as a premium would have to be negotiated and the RTM has not authority over the airspace.
