    flying freehold


    I own a proprty that has a flying leasehold over it, the attic room in question originally belonged to my property how do i go about buying it back if the neighbour is in agreement ?:

    Mosts leaseholds are flying; it's major reason why we have them.

    If you do not mean a flying freehold and that the attic room over your home is subject to a lease the neighbour, then you can see it if can be terminated under notice, if you have right to surrender at the end of the term, or negotiate to buy it.

    If it is a flying freehold then you can only negotiate it's sale to you, subject to any restrictive covenants or terms in the title eg giving you the right to first refusal.
