    Leasehold flat- use of allocated parking

    Hi all. Hope someone can help. I own a flat (leasehold) in a small block above a co op shop. There are 3 flats above and one below that has been changed to a doctors surgery. We each have 1 allocated space and on the register from when i purchased(before doctors) it shows down the side access 1 space for shop manager and 2 visitor spaces. Now the doctor has put signs for doctor and nurse in these spaces and written to us saying they are his and we can use them out of hours. So not only do 2 cars get parked there but 3 and sometimes 4 and if i park next to the 2 now marked out spaces i get letters telling me i shouldnt etc. The 2 visitor spaces were one of the conditions of planning and i would have thought at least i should have been notified if they were being sold? I would have bought them! Also should i have been notified about change of use to a doctors surgery?

    The story is not unusual, although there may be variants to the theme. It could become worse, the leaseholder could apply to the FTT, the agent and solicitors would rack up further costs and as you would expect the FTT is likely to decide that the costs are unreasonable.     Managing Agent A has ties to solicitor B. Block Company C has a flat owner D who was in arrears of, say, £1500.
    A advises C that D must be taken to court. B runs up costs of say £8000 preparing case and in anticipation of S146 follow through....

    Hi, many thanks for looking at this, it's much appreciated. The wording is exactly as in the deeds, "To use forecourt for access for parking not more than one vehicle there on" is exactly as written. It's a 100 year plus building which was converted in the sixtys? Maybe? Not sure if that helps!...

    If a freeholder incurs costs that a court does not say are recoverable from D, nor are they recoverable under the lease, then FH bears those costs out of their own pocket, or claims them from the "crook" (D). No reason other lessees should pay.

    FTT would not be the first port...
