I was a sole freeholder over two flats in a terraced house . I sold half of the freehold to the flat above which is subject to a 1987 lease, albeit rather old-fashioned . After the freehold sale had been completed the solicitor (only one was used as I thought a simple conveyancing task) pointed out he had always intended to create me a lease. Time has past and we are finally getting around to this. The owner of the flat above is keen to place a restriction on how I let my flat not allowing any short lets like Air BNB. I am keen obviously to keep available all ways in which I might choose to rent out my flat out my flat within standard UK law. I most likely will have cleared the mortgage by this point so will not have a lender’s concerns to deal with although there is currently a buy to let mortgage in place. Does anyone have any experience of clauses in leases restricting how you can let a buy to let flat? Thanks
What to include in creating a new lease to allow short lets

Reply to Changes to lease wordingby MacromiaEffectively, you have the opportunity to change anything within the leases of the nine participants that you all agree to - as long as this won't affect/contradict anything in the leases of the two flats who aren't participating (although parts of their leases can potentially be changed as well if all...

Our solicitor will extend leases to 999 years for an additional fee if we want to. She has asked, as part of that extension process:
“Are there any amendments that you are seeking to make...-

When the landlord offered the sale of the freehold we jumped at the chance because the landlord has always been extremely difficult, has often organised shoddily done work to the building...-

Reply to Levyby MacromiaIt really does matter.
If a leaseholder is being charged a "levy" then what that "levy" is for is directly relevant - without knowing additional details no one can do more than guess whether that "levy" can be charged at all, let alone what details may need to be...-

by jazzythumperSince obtaining the RTM and changing the managing agent, we have never been given full accounts / receipts for the previous year(s). We believe that as the old freeholder and leaser holder of one of the flats were represented by the same solicitor that prior to the sale of the freehold, we were subsidising...

Reply to Old managing agents accountsby Gordon999I suggest you apply to the local Magistrates Court for an order on the previous MA to provide the summary of service charges .
The RTM has powers to administer the service charge after hand over date going forward. But the period before handover , the service charge was under the previous...-
