    Collective enfranchisement ownership test

    Hi all,

    Quick questions (I hope), is the two year minimum ownership of a lease still a requirement to purchase the freehold via collective enfranchisement?

    I’ve seen legal articles stating it is and others reporting that it has been removed.

    If it is does this mean we have to wait for all owners to have had their flats for two years of for two years to have passed on all leases regardless of who owns them? And would it mean the freeholder can sell without offering us right of first refusal in the first two years?

    Two year ownership only applies to lease extensions. The freeholder has to offer to leaseholders before selling.
