    Bully Car Parkers

    I own a very nice modern flat it's one of eight flats in a block it has eight designated parking spaces there's a 63 foot gap where these parking spaces are each parking space is entitled to seven foot ten and a half inches however the occupier of Flat One takes up between nine foot six inches and ten foot he pushes the occupier of Flat Two over who parks over my parking space line the Freehold is taken the chap is in jail so it's been confiscated there is no Freeholder at the moment I require legal advice on how to sort this problem out laughing it seems a unlawful place where the big hand rules.

    Just to clarify, are you saying there is currently no Freeholder ? If so then who owns the land the block is sat on and the bricks your flat is built with ? The freeholder/management company would be the natural place to go for such a problem, a lot of blocks appoint a private parking firm who then put signs up and explain what will happen if you park where you should not, but only the freeholder can do this.

        I agree if the land was the leaseholders, but although we appear to have no freeholder we know for sure that the flat owner does not own the land so putting a bollard on '' someone else's '' land is not a good idea.

          I don't think it can be 'confiscated' as such. If you go to jail your assets aren't automatically seized. Do you mean the freehold has reverted to the Crown? If so, it might well be worth using your right for leaseholders to buy the freehold.

            I own some flats with the exact situation as described above, it works very well indeed and means i am a shareholder in the freehold company, it gives a greater degree of control over costs etc and i do not pay ground rent...... i would never buy a flat if it were not this model.

              I don't think that stands up. But even if it does, what's the downside?

              The absent freeholder suddenly turns up, starts taking on their responsibilities and demands the bollard is removed.
              -OK. Now sort out the parking problem.

                The chap who lives in the end flat whose causing the problem relatives own two of the eight flats and have encouraged this bad behaviour they have mental health problems in their family this is simply bad behaviour bullying in fact, we don't pay any ground rent there was some talk about approaching the Treasurery Solicitor however we can't do that until the Freeholder releases the Freehold to the Treasurery the Council simply won't allow the Freeholder to take back control of the Freehold a Solicitor was employed he didn't get anywhere only cost us money.
                I've spoken to the chap who takes all this extra room he simply said until there is a Freeholder he will continue to park as he likes I thought I'd bring this problem to Landlord Zone where there are experts with more experience than me here who can advise on this tricky position I find my flat and the parking spaces designated are on the Land Registry Plan I have attached two photographs which clearly show exactly what's happening, nobodies actually parking in my space only taking part of my parking space.

                    My reply to JPUCNG62 I can't park forward because the occupier in Flat 2 parks over my line The fault lies with the occupier of the end flat who should reverse park instead he forward parks he needs two foot to open his drivers side door then the occupier in the next flat (the old Ford Escort) parks over my line I'm the Owner/Landlord I don't actually live there I was thinking of dumping a scrap car there to be difficult lets be sensible I am thinking more on the lines of taking these two to the County Court trespassers nuisance parkers is there a legal eagle about who can advise.

                      This Freehold has been confiscated by the State so there is no Freeholder I think the best approach would be for my to take these two flat occupiers to the County Court I need advice from a Legal Eagle.

                          Since the Freehold was taken we all contribute our portion to the Building Block Insurance and also contribute for grass cutting we have a agreement for that, eventually the Freehold problem will be sorted though that looks it'll be years away. I would like to take these nuisance parkers to the County Court I'm looking for some advice on how to go about doing just that.

                            Other that the fact that one car has it's wheels over your, nicely painted white, lines is there any actual problem here?

                            I can see that the chap with the 4x4 is having access to his parking space restricted by the (incosiderate?) placing of those wheelie bins, which may be why he has to park to the side.
                            Maybe if the bins were not there he could/would park closer to the wall?

                            Then the next one seems to be parking much further over than he needs to be, thus encroaching on your nice lines.(Looks like he has to get in through his passenger door parking like that).

                                Clause one says that you are not to make any external alterations or additions.

                                The way it reads that includes free standing aditions. (Garage, outhouse, shed, etc).

                                Unlike the other two clauses, it doesn't mention consent at all, it's just a bare prohibition.

                                No great pearls of wisdom will come from employing a surveyor to work out the premium - they will give you a range of values depending on the capitalization rate and clearly you know how to do it - the ground rent does have a strong element of protection from inflation, but that is dependent on house...

                                The idea of a RTM Company is to remove yourselves from the freeholder, so I am not sure why you would wish to choose an agent recommended by the freeholder, but you can always suggest a trial and see how you get on.

                                The leaseholder can resign from the RTM Company but you will still have...

                                The service charge could be absolutely anything - may be £500 this year, but £20,000 next year, or even more when you find yourself one of the 1% of properties with cladding issues (or whatever comes next).

                                As eagle2 says, service charges (and service charge fraud) are where all the bodies...
