    Freeholder delaying flat sale

    My son has a top floor leasehold flat and is in the process of selling it. The process was going well until the purchaser pointed out that the lease plan did not match the actual flat (mainly the garden which had been divided by a fence up the garden middle rather than across it).This was not spotted when my son bought the flat and is now causing a big issue. He has had the lease plan redrawn to reflect the actual garden layout and approached the freeholders agent to get the lease amended to rectify the error in the lease. After initially asking for a "premium" to allow the lease to be changed (plus solicitor costs) this offer has been withdrawn and no new communication has been received. With the stamp duty holiday end approaching he is keen to get this resolved. Is there anything he can do to get the freeholder to cooperate?

    Yep, handing over a large chunk of wedge ought to do it.

        Id say your approach is all wrong! easier to physically move the fences to reflect legal ownership. Ownership trumps the actual arrangement on the ground. Inform the other lessee give him a copy of your legal plan and Just do it. You are entitled to fence land owned by your son under his lease. Put the fence an inch or two into the land owned by him so that no one can whinge

          Nice idea but these are flat conversions and the only way to access the garden would be to "fly" a staircase over to the rear garden from his flat... which is why presumably the fence was oriented along the middle and not across the middle.

            Do the leases of the two flats prohibit assignment of part?
