    refurbishment works without consent - damages to other flats

    Hi,
    I own a leasehold flat in a share of freehold building. One of the shareholder is in breach of the lease as they refurbished the flat without asking consent to the council and to the other shareholders. One flat has possibly been damaged from the works and a wall partition survey has been suggested. The person in breach has refused to start the procedure to have the retrospective consent granted from the other shareholders, which will include a full disclosure of the works done and the wall partition to assess damages. Lawyers got involved but still no collaboration from the people in breach. Should we notify the mortgage provider? if not, any other suggestions? Thanks.
