    Building with FH owning commercial units and flats

    I have been reading through a lease for a property with a commercial shop on the ground floor and two flats above...the Flat leases pay ground rent but the service charge apportionment is unclear....it does not state a percentage and I cant see it is apportioned by area the only percentage is towards the insurance 50% and the entrance hall and shared stairways....so do I get insurance for the flats based on them paying 50% each and they share costs of communal cleaning at 50% but how to work out what to charge them for everything else? It is not clear? Also does the commercial unit come in on their insurance or they get heir own for their ground floor area? This means getting two insurance policies..is that right? Also do they all pay towards external decoration as again the lease is unclear?...the commercial unit does say fair and reasonable but again no % or apportionment?

    WIthout your lease, it would be impossible to comment correctly, get a solictor to read the documents for you and comment, prior to making a purchase, you will need to pay for it.

      Why did you tell them ?
      If they want a ridiculous amount then just back out, no great loss and unlikely they will take action for the breach.
      If they do then deal with it then ....

      What does your lease say?
      What the lease says is what you do.

      I doubt the lease and RTM order say that they can charge a massive fee for managing the car park....

      The lease is a legally binding contract. The landlord cannot simply boss you around. If Freeholder wants lease altered must have your agreement.
      I have had professional dealings with Church commissioners. Their sole purpose is getting the money. Forget about any value in good relationships....
