    Reposessed leasehold in absence of lease

    Has anyone ever come across a case where, following the death of a leaseholder, the freeholder reposesses the leasehold of a property where there is no lease, land registry entry or any other record of ownership by the deceased?

    Was the lease granted at a time and in an area of England prior to compulsory registration and has never been registered ?

          Not as far as I'm aware. What happens if none can be found?

            You could try making application to the local magistrate court issue for an order on the freeholder to show a copy of lease , as last resort. You need a record of the council tax billings to show the person lived at the address. .

              I'm pretty sure the freeholder doesn't have one either.
