    Freeholder ignoring requests for EWS1 Survey

    Looking for some advice on how to progress with this problem. Myself, along with quite a few of the other leaseholders in my block are trying to remortgage and getting refused because of the EWS1 hurdle. We have contacted the management company who have sent 2 separate quotes over to the Freeholders (based in Hong Kong) to approve having the survey completed, as without it nobody can buy/sell/remortgage their flat, but the freeholder is not responding, these quotes were sent over months ago!

    What can we do about this? Surely there must be a way to force having an EWS1 survey done without the freeholders permission as it is having such a significant financial impact on the leaseholders.

    Any help would be greatly appreciated.

    Why isn't the management company organising for it to be conducted? That's the whole point of them being appointed is to manage the property. Is this to complete the survey or undertake the works, either way the leaseholders would be paying this via an increase in service charge or taken out of any sinking fund.

      Perhaps the freeholders know the cladding is potentially combustible and their silence is on the advice of their lawyers.

        How tall is your building, is it above 18 meters or below? Does your building have balconies or any type of panels on the external wall system? If it's below 18 meters and brick walled without any apparent cladding, the bank should not be rejecting your mortgage application. This is according to RICS own website. RICS also states leaseholders cannot initiate the EWS1 themselves, which is of course cunningly conning.

          Make a complaint to your local MP and ask him or her to join the APPG for leasehold reform.

            That seems like a great idea letting out a spare room. Make sure its someone who would not feel intimidated. Also agree with Xmas cards every bit helps. Also tell all contractors not to engage with them at all and ignore them....

            If I asked the managing agents for a situation report regarding overall arrears of service charge, are they duty bound to let me know. not by flat,of course, but as a % of total invoiced, with info regarding length of arrears?

            There is no reason why you cannot request and no reason why the managing agent cannot supply general information regarding the level of service charge arrears. It would only become an issue if any personal information was supplied or could be identified,

            OK....no i am not one of those........ but seems odd then that the managing agent was very quick to tell all leaseholders in writing that a certain % of leaseholders had paid in advance of a large section 20, by way of coercion to those who had not paid.

            Have you thought about renting the place and just giving the old neighbour an email address for communication with an auto response saying I only pick up email from this account once a month. Not ideal but another option.
