    Ground rent payment by other leaseholders

    I have been asked for backdated ground rent by the freeholder which is fine as within the terms of the lease.

    I want to know if this backdated ground rent has also been requested to other leaseholders as I’m not convinced it has been, and the freeholder won’t tell me. Do I have any rights to demand this information? Thanks.

    No, and he can only claim back ground rent after correctly serving s166 notice.

      Thanks. 3 years backdated ground rent and all correctly requested.

      I don’t think he has asked for this from all the leaseholders, but I guess I have no way of finding out other than conversations with those leaseholders I know.

        There is no obligation for freeholders to collect the ground rent that a lease entitles them to, and there is therefore no reason why they would have to ask all leaseholders to pay their ground rent (however unfair that might seem).

          Your flat may be the only one in arrears of ground rent. Consult the other leaseholders about collectively buying the freehold title.

              The RTM can make a money claim online but as this enquiry concerns service charges the lessee will have the right to have the service charges determined unless already agreed. Depending upon the lessee's response to the claim, the County Court may refer the claim to the FTT.
